Booking Terms
1. Purpose of the Agreement
These Booking Terms set out the basis on which the Guest agrees to book and occupy the property.
- The booking is for holiday use only and does not create a tenancy or any right of occupation under the Housing Act 1988.
- This booking is expressly excluded from the Protection from Eviction Act 1977, meaning the Guest has no right to remain in the property after the agreed booking period.
- By confirming the booking, the Guest agrees to these terms in full and acknowledges that they form a legally binding contract between the Guest and the Property Owner.
2. Definitions
- Owner means the person or business responsible for managing or letting the property.
- Guest means the person named on the booking and all members of their party.
- Property means the holiday accommodation identified at the time of booking.
- Booking Platform refers to the website or service used to complete and confirm the booking.
- Security Bond means the refundable deposit held against damage, breakages, or breach of these terms.
3. Booking and Payment
- A booking is confirmed only when payment has been received and the Guest has agreed to these terms.
- A non-refundable deposit is payable at the time of booking, with the balance due by the date specified during checkout.
- If the balance is not received by the due date, the Owner reserves the right to cancel the booking and retain the deposit.
- A Security Bond may be required. This will be refunded within seven (7) days of departure following inspection of the property. Deductions may be made for damage, missing items, or excessive cleaning.
- Prices include standard utilities (electricity, gas, water) unless stated otherwise.
4. Use of the Property
- The property may only be used for private holiday purposes and must not be used for business, commercial, or social events without prior written consent.
- The maximum number of guests permitted is as stated in the property description. Over-occupancy is not permitted.
- Only the named guests on the booking may occupy the property. Visitors are not permitted to stay overnight without the Owner’s prior consent.
- The Guest must comply with all site or park rules where applicable.
- The Owner or their representative has the right to refuse entry or require any person to leave if these terms are breached.
5. Guest Responsibilities
- The Guest agrees to keep the property, furniture, fixtures, and fittings in good, clean, and tidy condition.
- The Guest must immediately report any breakage, loss, or damage to the Owner.
- The Guest must not:
- Cause damage to or remove any part of the property, its contents, or external features.
- Make any alterations or additions to the property.
- Do or permit anything that may cause nuisance, disturbance, or annoyance to neighbours.
- Bring any pets onto the property unless explicitly allowed at the time of booking.
- Smoke or vape inside the property; it is a strictly non-smoking accommodation.
- Use candles, barbecues, or other open flames inside the property.
- Assign, sublet, or share the property with persons not named on the booking.
- The Guest must remove all personal items and dispose of rubbish in the designated bins before departure.
- The Guest is responsible for ensuring their own belongings are insured. The Owner accepts no liability for theft, loss, or damage to the Guest’s personal property.
- Protective bedding covers are provided for hygiene purposes and must not be removed. Removal will result in forfeiture of the Security Bond.
6. Owner Responsibilities
- The Owner agrees that, subject to these terms and full payment, the Guest may peaceably occupy the property during the booked period without interruption.
- The Owner will ensure the property is clean, safe, and fit for occupation in accordance with the Occupiers’ Liability Act 1957.
- The Owner will maintain suitable insurance for the property and its contents (excluding the Guest’s possessions).
- The Owner will make reasonable efforts to repair or replace any malfunctioning appliance or service within a reasonable timeframe once notified.
7. Security Bond and Damages
- A refundable Security Bond may be taken to cover damage, breakages, or breach of terms.
- The property will be inspected after each stay. The bond will be refunded within seven (7) days unless deductions are necessary.
- In cases of significant damage, loss, or additional cleaning, the Owner reserves the right to recover costs exceeding the bond amount.
8. Behaviour and Conduct
- The Guest and their party must behave in a considerate and respectful manner at all times.
- Excessive noise, disruptive behaviour, or antisocial activity may result in immediate termination of the booking without refund.
- Illegal substances, fireworks, and weapons of any kind are strictly prohibited.
9. Health, Safety, and Hygiene
- Guests must familiarise themselves with all safety information provided, including emergency exits, fire extinguishers, and evacuation procedures.
- Smoking or tampering with smoke detectors is strictly prohibited and may result in forfeiture of the Security Bond.
- Guests must comply with any site-specific health, safety, and hygiene rules.
- The Owner shall not be liable for loss or injury arising from misuse of the property or its facilities.
10. Cancellations and Refunds
- If the Guest cancels a booking:
- The deposit is non-refundable.
- If cancellation occurs within [insert number] days of arrival, the full balance remains payable unless the Owner can re-let the property.
- If the Owner cancels the booking for any reason beyond their control (e.g. property damage, essential maintenance, or emergency closure), all monies paid will be refunded in full. The Owner’s liability is limited to the total amount paid by the Guest.
11. Liability
- The Owner shall not be liable for death, personal injury, loss, or damage unless caused by their proven negligence.
- The Owner shall not be responsible for temporary failures in supply of utilities or services beyond their control.
- Guests use the property and its facilities entirely at their own risk.
12. Termination of Stay
- The Owner reserves the right to terminate a stay without refund if the Guest breaches these terms or behaves in a manner deemed unsafe or inappropriate.
- The Owner or their representative may enter the property at reasonable times to inspect or carry out essential maintenance.
13. Complaints
- Any complaint regarding the property must be reported to the Owner or representative immediately to allow remedial action.
- Retrospective complaints raised after departure may not be accepted if the Owner was not given an opportunity to rectify the issue during the stay.
14. Governing Law and Jurisdiction
- These Booking Terms shall be governed by and interpreted in accordance with the laws of England and Wales.
- Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
- No person other than the parties to this booking shall have any rights under the Contracts (Rights of Third Parties) Act 1999.
15. Acceptance of Terms
By confirming a booking and ticking the acceptance box, the Guest acknowledges that they have read, understood, and agree to abide by these Booking Terms in full.
